going to retire now, and as your son I want half of everything you�ve got.
Half your house, and half your servants, and you can kick in that mistress
of yours that�s too young for you.�

I (p.d., that is) pulled out the deed to my dad�s house. �I�m afraid I�ve

�Dad, I am your heir,� I said.
�Son, I have to be dead for that,� Dad replied. He cleared his throat.
�Let�s say you get hit by a truck tomorrow, son. You die. Then, two years
later, I (dad) die. Are you going to take my property, as my heir?
�Ummmm,� I said. �I guess I can�t. I died before you did.�
�Right,� Dad said.
�Well, I still don�t like that,� I said. �That�s typical of you, dad.
You�re always hiding behind legal technicalities. Fact is, Dad, I�m you�re
son, and any idiot knows that means I�m your heir. Gimmie half of your
house!�
�Son,� Dad said. �It�s time you learned the difference between
words of purchase, and words of limitation.�
To George O. Wilson, and his heirs.
�What estate in land does that phrase convey, son?� Dad asked me.
�Simple, dad,� I replied. �It conveys a fee simple absolute.�
�Correct,� Dad said. �Now son, I�ve got bad news for you. Although
I�m old and have white hair, and might die soon, I�m sick of this house. I�m
going to sell it and move to Bermuda. I�m going to date underage girls and
buy them drinks and lots of slinky underwear. I�m going to spend all my
money on them and die a penniless bum, lying on the beach in Bermuda.�
�You can�t!� I screamed. �I get half of that mansion there, Dad. You
can�t sell it! It says right in the deed to the mansion, conveyed to you by
Howard Hughes,
To George O. Wilson, AND his heirs.
My dad cleared his throat. �Son, in the 1100�s, some courts might
have agreed with you,� Dad said. �But by 1225 it was settled that if I,
George O. Wilson, should sell this mansion, perhaps to Andrea Dorkin, or to
anyone...� his eyes brightened. �you, son, get no part of it after my death!�
I frowned. �Hmmm, let me get this straight,� I said. �Howard
Hughes conveys his mansion to you.�
�Correct,� Dad said.
�And in his deed, that he gives to you, Howard writes:
To George O. Wilson, and his heirs.
�And now you, Dad, in your old age, decide to sell the mansion to
Andrea Dorkin. Then you die. I get nothing?!� I asked.
�That�s right!� Dad grinned. �That�s because �to George O. Wilson�
are words of purchase, while �and his heirs� are simply words of
limitation.�
�What?� I asked.
�Words of purchase show WHO is getting something. Like me, George
O. Wilson. When Howard Hughes conveys his mansion to me, the words �to
George O. Wilson� indicate that I, George O. Wilson, am receiving the
mansion. I �take� it, to use legal terminology. But the words �and his
heirs� indicate the QUALITY, or type of estate that I�m taking. For
instance, had the deed simply read,
To George O. Wilson
�What type of estate would I take, son?� Dad asked.
�A life estate,� I replied. �It would last for your entire life, and no
matter how much you wished for me to have it, upon your death it would
revert to Howard Hughes.�
�Yes indeed,� Dad answered. �I would have a life estate, and Howard
Hughes would have a Reversion. And when I died, son, he�d get his mansion
back, and the land upon which it sits, and you�d get nothing.
�So,� Dad says. �What is the ONLY way I can ensure that I get what I
paid for from Howard? How do I ensure that I get a fee simple, and not
simply a life estate?�
�Well,� I mused, �Dad, I guess you�d have to add those magical
words, �and his heirs.� So the deed reads,
To George O. Wilson, and his heirs.
�Yes!� Dad says. �But why are those words there, �and his heirs�?
Are they there to give YOU something, son, you no good lazy bum who
spends all his time watching MTV?
�No,� I had to admit. ��and his heirs� is simply added to show that
you, dad, are getting a fee simple, and not a life estate.
�Now let�s make a chart,� Dad said. �A chart of all the freehold
estates.�

heirs� are simply words delimiting what kind of estate is in fact being
granted?�
�Yes, son, and that�s an excellent word to use,� Dad said. �Delimit.
Let�s look that up in the American Heritage dictionary:
Delimit: To establish the limits or boundaries of; demarcate.
�This is what we mean when we speak of words of limitation. As in,
�and his heirs.� They delimit what type of estate I will take.�
To George O. Wilson, and his heirs.
�Oh,� I said. �I get it, Dad! �To George O. Wilson� means to you, dad,
as opposed to say, William Dockery. And �and his heirs� establishes the
type of estate you�ll take. It defines the boundaries of it, in Law, as being
a fee simple which, fortunately, is the best estate you can take, because
it can last forever. If you don�t sell it, and if you die BEFORE me, I will
then, and only then, get your mansion, and after me my son will get it, and
so on, for as long as there are Wilsons, all the way into eternity.�
�Yes, son,� Dad said. �But I�ve got bad news for you. If I decide not
to sell my property I�m going to leave it in my will to the Chiquita Banana
Company, because I like their bananas. So you still won�t get anything
when I die. Unless, that is, I decide to rescind my will, because I see you
working hard and raising a family and obeying the law and not spending
your time posting porn on the Internet!�
�Oh yeah,� I said. �But assuming you didn�t sell the mansion during
your lifetime, and assuming you DIDN�T make a will and leave the mansion
to the Chiquita Banana company, and assuming I, p.d., didn�t get hit by a
truck and die before you, then I would INDEED get that fucking mansion
when you died, dad! Whether I post porn on the Net or not!�
�True,� Dad replied. �But that is because Howard Hughes conveyed a
fee simple to me. Inheritability is an aspect of a fee simple. (And not, for
instance, of a life estate.) But the words �and his heirs� in the conveyance
ESTABLISH that it is a fee simple I�m taking. They don�t give you anything,
son. It�s just that, BEING a fee simple, the land will pass to you, son,
when I die, assuming I don�t in the meantime sell the land to Andrea
Dorkin or leave it in my will to the Chiquita Banana company.�
�And assuming I don�t get hit by a truck and die before you do, dad,� I
(p.d.) added.

words of limitation are written in each case,� Dad said.

�That�s right,� Dad smiled. �Back to collecting cans, son! This
mansion with �your� bedroom in it belongs entirely to me! The television
that shows MTV, the closet where you tried hiding your Playboys,
everything! Mine! Mine! Mine! Get your lazy ass off MY land and don�t
come back!�
So I sat on the curb with P.D. as he sucked on his unlit, discarded
butt of a cigarette. Behind us the sun was going down and you could see
his Dad�s mansion in the distance, but he wasn�t allowed to go there. So
he was homeless just like me and collecting cans.
�Bummer,� I (holy joe) said to P.D.
�Yeah, it�s a bummer,� P.D. agreed with me. �Here I thought, all
along, growing up in that house, that I was entitled to something, when in
fact it all belonged to my dad. Even when I was under 18 none of it
belonged to me. He just had a responsibility to take care of me, that�s all.
Even then I owned no part of the house. And it�s all because of those pesky
little words, and what they stand for: �and his heirs.�
�Well,� I said. �Perhaps someday we can change the law. We can
make �and his heirs� stand for the kids getting something too, not just the
parents who buy the house.�
�What? Are you kidding? My kids are lazier than I am!� P.D.
declared. �The words �and his heirs� can stay just as they are, thank you,
as words of limitation, not as words of purchase. If my kids want a house
they�ll have to buy a house of their own. They�re not getting mine!�
